Sidetick encourages you to use our service as long as you abide by Sidetick's Terms of Service ("TOS"). Sidetick's TOS prohibits users from engaging in spamming and other unethical marketing activities, such as sending chain letters and pyramid schemes.

 

To help our users understand the rules of usage, Sidetick has adopted this SPAM Policy. As a service to our users, we have identified the following examples of activities that may violate the TOS and Sidetick's SPAM Policy:

• Manipulating identifying information, such as email headers or other transmittal information, with the intent to disguise the origin of any content transmitted to or through Sidetick computer systems or to Sidetick users.

• Retransmitting email from a third party's computer system without that third party's consent.

• Using, or causing to be used, Sidetick computer systems to facilitate the transmission of unsolicited or unauthorized materials, including chain letters, pyramid schemes, or other unauthorized solicitations, to users or any other third-party.

• Using automatic scripts, including "spiders" or "robots," or otherwise harvesting users' email addresses from the Sidetick Website for any purpose.

• Uploading, posting, emailing, or transmitting the same message, URL, or post multiple times.

• Acting in a manner that negatively affects other users' ability to engage in real-time exchanges through the Sidetick system.
  

Certain Sidetick services may have additional SPAM guidelines explaining appropriate conduct for those services. Those additional policies are incorporated by reference into the Sidetick SPAM Policy. You are responsible for checking any additional guidelines for such services.

 

We or our users may pursue any and all available legal remedies against users who violate our TOS or this SPAM Policy. Such remedies include, but are not limited to, (i) litigation; (ii) termination, without notice, of your Sidetick ID and/or associated accounts, including, but not limited to, email accounts, clubs, posts, home pages, and profiles; or (iii) referral to the Federal Trade Commission or appropriate state agency. Nothing in this policy is intended to grant any right to transmit email to or through Sidetick computer systems. Sidetick's failure to exercise any of its rights or to enforce this SPAM policy does not act as a waiver of any right available under this SPAM policy.

 

NOTICE: Sidetick computer systems use or cause Sidetick servers located in Georgia. Unauthorized use of Sidetick computer systems is a violation of the TOS, Spam Policy, and certain federal and state laws, including the Computer Fraud and Abuse Act (18 U.S.C. § 1030 et seq.) and various state laws. In addition to other remedies available to Sidetick or its users, any violations may subject the actor and his or her agents to civil and criminal penalties.

 

Please report violations of this SPAM Policy to Sidetick.
